Home Improvement Contract

Supply and installation of Eight (8) series replacement windows and TWO (2) series sliding patio doors with WHITE vinyl frames, dual panes with Low E366, argon gas, super spacer and insect screens.

We hereby request you to furnish and install the above products at above address at the price and terms. Upon completion of the installation, we agree to execute and deliver to you a certificate of completion and make payment according to the terms of this contract. The undersigned authorize Newpane and/or their assignee to investigate credit and verify employment history. We acknowledge and understand that the representative signed this contract is an independent dealer and is not your agent, and that any statements or representations made by him/her are not binding on you until: (1) Your acceptance thereof in writing or (2) Your processing any portion of the manufactured products into lay out. (3) Verbal statements are not binding. All work to be done will be in writing. We further acknowledge and understand that the installation of thermal glass does not absolutely guarantee the complete elimination of condensation. We understand that most condensation problems are solved but is determined by temperature and humidity. All wood must be sealed within 30 days or warranties therefore are void. One year labor warranty, unless otherwise specified, and all Manufacturer's warranties apply. We acknowledge that we have read and understand the above and received a copy of this contract.

To: Owner

All work to be completed in a workmanlike manner according to standard practice. If contract is not paid in full, all warranties are void. All agreements are contingent on strikes, accidents or delays beyond our control. The contractor, Newpane, agrees to carry workman's compensation and public liability insurance and to pay all sales tax, social security and unemployment compensation taxes on the labor and material furnished under this contract as required by the State of Washington. Homeowner is responsible for all building permits that may be required. Homeowner has been informed of all lead based paint laws required by EPA.

NOTICE TO BUYER

You the Buyer may cancel this transaction at any time prior to midnight of the third business day after the date of this transaction. See below for the notice of cancellation form for an explanation of this right.

YOU MAY CANCEL THIS TRANSACTION WITHOUT ANY PENALTY OR OBLIGATION WITHIN THREE (3) BUSINESS DAYS FROM THE BELOW DATE.

IF YOU CANCEL, ANY PROPERTY TRADED IN, ANY PAYMENTS MADE BY YOU UNDER THE CONTACT SALE, AND ANY NEGOTIABLE INSTRUMENT EXECUTED BY YOU WILL BE RETURNED WITHIN TEN (10) BUSINESS DAYS FOLLOWING RECEIPT BY THE SELLER OF YOUR CANCELLATION NOTICE, AND ANY SECURITY INTEREST ARISING OUT OF THE TRANSACTION WILL BE CANCELLED.

IF YOU CANCEL,YOU MUST MAKE AVAILABLE TO THE SELLER AT YOUR RESIDENCE, IN SUBSTANTIALLY AS GOOD CONDITION AS WHEN YOU RECEIVED, ANY GOODS DELIVERED TO YOU UNDER THIS CONTRACT OR SALE, OR YOU MAY, IF YOU WISH, COMPLY WITH THE INSTRUCTIONS OF THE SELLER REGARDING THE RETURN SHIPMENT OF THE GOODS AT THE SELLER'S EXPENSE AND RISK.

IF YOU DO MAKE THE GOODS AVAILABLE TO THE SELLER AND THE SELLER DOES NOT PICK THEM UP WITHIN TWENTY (20) DAYS OF THE DATE OF YOUR NOTICE OF CANCELLATION, YOU MAY RETAIN OR DISPOSE OF THE GOODS WITHOUT ANY FURTHER OBLIGATION. IF YOU FAIL TO MAKE THE GOODS AVAILABLE TO THE SELLER, OR IF YOU AGREE TO RETURN THE GOODS TO THE SELLER AND FAIL TO DO SO, THEN YOU REMAIN LIABLE FOR PERFORMANCE OF ALL OBLIGATIONS UNDER THE CONTRACT.

This contractor is registered with the state of Washington, registration no. NEWPAL*895JQ, and has posted with the state a bond or deposit of $12,000.00 for the purpose of satisfying claims against the contractor for breach of contract including negligent or improper work in the conduct of the contractor's business. The expiration date of this contractor's registration is 04/13/1013.

THIS BOND OR DEPOSIT MIGHT NOT BE SUFFICIENT TO COVER A CLAIM THAT MIGHT ARISE FROM THE WORK DONE UNDER YOUR CONTRACT.

This bond or deposit is not for your exclusive use because it covers all work performed by the contractor. The bond or deposit is intended to pay valid claims up to $12,000.00 that you and other customers, suppliers, subcontractors, or taxing authorities may have.

FOR FURTHER PROTECTION YOU MAY WITHHOLD A PERCENTAGE OF YOUR CONTRACT.

You may withhold a contractually defined percentage of your construction contract as retainage for a stated period of time to provide protection to you and help insure that your project will be complete as required by your contract.

YOUR PROPERTY MAY BE LIENED

If a supplier of materials used in your construction project or an employee or subcontractor of your contractor or subcontractors is not paid, your property may be liened to force payment and you could pay twice for the same work.

FOR ADDITIONAL PROTECTION YOU MAY REQUEST THE CONTRACTOR TO PROVIDE YOU WITH ORIGINAL "LIEN RELEASE" DOCUMENTS FROM EACH SUPPLIER OR SUBCONTRACTOR AT YOUR PROJECT.

The contractor is required to provide you with information about lien release documents if you request it. General information is also available from the state Department of Labor and Industries.
